Upon execution of this contract Westerly Car Club And Vault will assist you to set up an online account accessible at WesterlyCarClub.com to schedule your vehicle for check in and check out.
Every effort will be made to action all request or instructions given or received in relation to your vehicle including any additional services requested on the date, we reserve the right to be flexible in regard to specific timing or due dates.
Standard Fees: Westerly Car Club And Vault is a monthly renewable contract with a term of one month. The initial deposit is zero with an additional monthly charge of two hundred and fifty dollars a month including battery trickle charge Client agrees to pay a monthly fee of two hundred and fifty dollars, by credit card. Payment will be charged monthly on a recurring basis.
Terms and Conditions: The following are the Terms and Conditions of Westerly Car Club And Vault. These Terms and Conditions will apply as The Company’s “Terms of Business” with regard to all services supplied. We may revise these Terms of Business from time to time, we will take reasonable steps to notify you of any changes, however it is your responsibility to check for the current version. Procedural stipulations may be deviated from at our discretion. Here within, The words “We” “Us” “Our” “The Company” will refer to Westerly Car Club And Vault. The words “You” “Your” “Yours”, will refer to the Client.
We reserve the right not to enter into any contract with any individual or with regard to any vehicle, without reason. Documentary evidence with regard to the Identification of both the Client and the Vehicle must be made available for inspection and record once an initial proposal has been accepted. By entering into this contract with us, you willfully accept all of our terms and conditions here within, in every regard and agree to pay all fees. The terms of this contract will be governed by Rhode Island law and statutes.
Contract Termination: Client can cancel the renewal of this contract at any time prior to the end of the month to month contract. Cancellation is for the renewal of the month to month contract. All contracts are month to month. Cancellation must be made in writing by email to Westerly Car Club And Vault Management prior to 10 days before the contract end date.
Upon cancellation of the renewal of the contract the vehicle is required to be out of the facility prior to the end of the contract period. If vehicle is still on the premises on the first day of the contract end date, the contract will automatically renew for a one month period. If contract has not been requested to be cancelled during the required notification period, contract will automatically renew. We reserve the right to cancel your contract renewal or current contract.
Identification: You must provide documentary proof of both your identity and permanent home address by means of Passport or Driver License, which we will hold on your personal file. You personally guarantee that all information provided by you is true, accurate and correct. All contracts will be with persons of minimum 18 years of age.
Vehicle: You must provide us with documentary proof that you have either ownership or legal charge over the vehicle or vehicles that you propose to place with us.
This may be via a copy of a Vehicle Title or Vehicle Registration. All information will be copied for our files. You may not place a stolen or illegally possessed or repossessed vehicle with us.
Any such attempt will be reported to the police. You shall, prior to our completion of any contract, notify us in detail of any special issues, conditions, requirements or precautions that may be particular to your vehicle or type.
The vehicle will be presented for inspection prior to acceptance for entry to storage in a condition that presents no likelihood of risk of damage or injury, to either our staff or representatives, or other vehicles within the facility or the facility itself. No explosive or dangerous articles may be left within the vehicle. All personal items should be removed from the vehicle.
No responsibility will be held for any items remaining.
Battery condition can be affected dramatically when left for prolonged periods of without use. We will not be liable for battery deterioration.
You agree to indemnify and hold harmless Westerly Car Club and Vault, its members and shareholders, successors and assigns from any and all claims, demands, liabilities, costs, charge, attorneys fees and other costs or expenses of any nature whatsoever against any loss or damage to the Vehicle from any cause whatsoever, including the negligence of Westerly Car Club and Vault.
Any additional resources used to start your car other than turning the key and it starting will be charged for at fair market value. You agree to pay these fees as they are invoiced. You may have up to one additional car on file with us per space.
This means you can drive to us in car one and schedule car two to be ready on your arrival. Car one goes on the rack as you drive you away in car two. All terms and conditions apply to both vehicles.
PERSONAL DATA AND SECURITY We will only use your personal data for internal purposes in order to fulfil our obligations under our contracted terms. We will not share your personal data with third parties. Only if we are required by law, your information may be disclosed to police or other United States government agencies. You must provide us with all and any updates to information held on our file to ensure that such information is accurate and current. Please notify us if you change your email or mobile telephone number. Payment: Payment of two hundred and fifty dollars, $250.00, by credit card for the initial month is required upon execution of contract.
We may make adjustments to our charges from time to time. Any alteration to published costs will be notified. If the credit card on file is not able to be charged, Westerly Car Club And Vault will call and email you to get a new card on file. If no new credit card is provided or payment cannot be made you agree to grant Westerly Car Club And Vault to place a lien on the vehicle or vehicles. This applies to both storage and any additional services provided.
INSURANCE AND LIABILITY: It should be noted that we take our responsibilities for the care of your property extremely seriously. We have procedures in place to ensure that your vehicle is handled, stored, and serviced with the utmost care.
You must insure your vehicle against fire, theft, accidental damage whilst in our facility and any other risks as you may require to be insured against. The Company does not accept any liability for destruction, damage or loss to the vehicle or any items contained within the vehicle howsoever caused. Documentary evidence of your insurance must be provided.
The Company will not be held liable for any and all losses or damages to the vehicle howsoever caused by us or any third party, or as an act of nature either within or outside of our site or within or outside of our control in connection with the placement of your vehicle with us.
This Agreement shall be binding upon and inure to and for the benefit of the parties, its successors, assigns, agents or representatives. This Agreement shall further be governed by the laws of the State of Rhode Island.
